Medical Negligence Claims
Humans make mistakes but that does not mean you cannot claim
Suffering from an injury or serious illness/disease is distressing. If you think that the situation has been made worse by the doctor/nurse or person providing treatment the stress could be almost unbearable. Unfortunately, it does happen as those administering treatment are human. Humans make mistakes but that does not mean you cannot claim.
Clinical and Medical Negligence claims are different from ordinary personal injury claims. You as the person claiming, (The Claimant) must prove two important points:
- That the healthcare professional (Doctor/Consultant/Nurse) failed to carry out their responsibilities (Fault) and
- hat this is what caused you to be in the position you are now in (Avoidable)
Fault: This basically means that for the type of treatment you received, your care fell below that expected of a reasonably competent and skilful specialist. In other words, they did not treat you the way you could reasonably hope to have been treated.
Avoidable Harm: Causation- So in other words you need to show that the negligent care caused you the injury (harm). This may sound fairly easy but can be difficult. We will need to obtain a report from an independent medical expert to help prove both of these issues and we will be able to arrange and sort this out.
You usually have three years of the date of your injury or of the date when you first discovered that your injury was the result of medical or clinical negligence. Some evidence relies on memory so it is always best to record these details when they are fresh in your mind. We need to be given the earliest opportunity to investigate your case so we need to this as soon as we are able.
